unc officials: Willingham lawsuit should be tossed


Three administrators at the University of North carolina at Chapel Hill have asked a federal judge to dismiss a lawsuit filed by Mary Willingham, a former academic adviser who public criticized literacy levels of unc athletes amid investigations into academic fraud at the school.


Willingham filed suit in July against the university, claiming the school retaliated against her for speaking out by altering the terms of her employment in July 2013, including a demoted rank and title and additional job duties that would require "extensive training."


She also alleged in an amended lawsuit that Chancellor Carol Folt, Provost James Dean and Roberta "Bobbi" Owen, former senior associate dean for undergraduate education in the College of Arts & Sciences, slandered her by calling her a "liar" and research into athlete literacy levels a "travesty."


The motion to dismiss Folt, Dean and Owen as defendants notes that Willingham resigned from unc-Chapel Hill at the end of the 2013-14 school year and maintains the lawsuit is improper because Willingham didn't complete the university grievance process and exhaust all appeals before turning to the court for damages.


"Plaintiff's amended complaint is an improper attempt to obtain damages for the loss of a job she chose to quit," the motion states.


The three officials also are protected by immunity from her claims for actions they took in their official roles, according to the motion.


unc-Chapel Hill lawyers asked in August for Willingham's lawsuit to be dismissed against the university.


Former federal prosecutor Kenneth Wainstein released a 131-page report in October detailing his investigation into fraudulent grades and coursework at the university. He found that academic counselors steered student-athletes to "irregular" classes within unc-Chapel Hill's African and Afro-American Studies Department that had no faculty involvement and never met. The fraud went on for 18 years, ending in 2011, and involved 169 athletes whose grades in such classes kept them eligible to compete in athletics.

THE NCAA APPROACH


When Penn State commissioned an outside inquiry into the university's mishandling of child abuse by football assistant coach Jerry Sandusky, the NCAA made the unprecedented step of accepting the report outright and acting on its findings instead of conducting its own investigation.


Two years later, North carolina commissioned an independent investigator to look into irregular classes in its AFAM Department. But this time the NCAA is taking a completely different approach in dealing with the report's findings.


"That stepped completely outside of everyone's protocols and processes," unc athletic director Bubba Cunningham said of the NCAA/Penn State case. "We're not doing that."


As a result, the NCAA is dealing with a different set of circumstances as it conducts its own investigation into unc's potential violations stemming from the academic scandal.


For instance, the investigative report on unc, which was released in late October, used the testimony of Deborah Crowder, the AFAM office manager and the supposed mastermind behind the faulty classes. Under pressure from the State Bureau of Investigation and the Orange County District Attorney, Crowder agreed to cooperate with former U.S. Attorney Kenneth Wainstein and his staff and sat down for 25-30 hours of interviews.


However, Crowder is under no obligation to speak with the NCAA and will refuse to do so if asked. It's also doubtful that other important subjects who cooperated with Wainstein and no longer work at unc will meet with the NCAA.


And even if the NCAA wanted to use the tapes from the Wainstein interviews, many of them don't exist. Crowder and men's basketball academic counselor Wayne Walden were among the key figures whose interviews with Wainstein's staff weren't recorded.


A source familiar with how Wainstein conducted his investigation said that interviews weren't taped not because of a request from unc, but because a recorder in the room has a chilling effect on witnesses, who become less forthcoming if they know an interview will be recorded for posterity.


There are other unprecedented actions from the NCAA/Penn State case that weren't repeated at unc. The NCAA seemingly took an active role during the Penn State investigation conducted by Louis Freeh, e-mailing Freeh's firm a list of 32 questions to ask witnesses. The NCAA suffered significant blowback when the e-mail became public, and the Wainstein source said the NCAA never prepared questions or influenced any of the unc interviews. The Wainstein team met with the NCAA three times but it was only to share information and provide updates.


Wainstein's staff does have a general understanding of the NCAA's rulebook - the NCAA hired Wainstein last year to look into whether its enforcement staff acted inappropriately during its investigation of Miami. But while Wainstein's team brought issues to unc's attention during the process, it pointedly did not determine violations in its report. For example, Wainstein did not conclude if some athletes maintained their eligibility by taking the irregular classes, which could be a key part of the NCAA's inquiry.


While unc implemented a hands-off approach with Wainstein, it's working hand-in-hand with the NCAA during this new probe.


"In the Penn State case, the (NCAA) never did an investigation. They just took the report and said, 'These are all facts,'" Cunningham said. "Our case is Wainstein did a report and an investigation, and here's their presentation. Now together we'll go through that and say, 'Okay, this is what we agree on or don't,' as we do with every other fact associated with this case. So we're following that process."


unc has also hired the outside counsel of Bond, Schoeneck & King, which has represented more than 60 Division I schools and has conducted more than 100 potential major infractions case investigations.


NCAA president Mark Emmert praised unc's cooperation with the enforcement staff, which could serve to mitigate potential penalties.


"The university has been very forthcoming working with our people," Emmert told CBS Sports earlier this month.


Emmert also seemed to give unc credit for investigating itself and finding issues that never came up during the previous NCAA probe into the football program.


"I was impressed the university committed the energy and resources to do that study and they made it public and they rolled it all out there, and that's a very hard thing for a university to do," Emmert said. "Here's one of the great universities on Earth and they're working very, very hard to get this right."


Emmert reiterated that the Penn State case was unique "in the magnitude of the misconduct," and that other cases would follow NCAA protocols.


The fact that the NCAA will not parrot Wainstein's report, and must conduct its own investigation with the school, is good news for those who criticized or questioned certain conclusions reached by Wainstein that were unfavorable to the athletic department, such as how much coaches and academic advisors knew about what was happening on the academic side of campus.


But it also helps explain why the latest NCAA investigation, which started in June, continues today - a frustrating circumstance for people who have been waiting for a final resolution since 2010, when the NCAA first came to Chapel Hill.

The last we heard from SACS , they had sent a warning letter to unx. They weren't happy. Clearly , unx had lied to 'em about the pervasiveness of the fraud. SACS' "punishment" the first time didn't even rise to the level of "wrist-slap." They're still in the process of reviewing unx's case. The school has 30 days to respond once SACS makes their decision. We'll see. BTW , props to Roy on only his SECOND signee in a year and a half. Another legacy too. If ya can't land anyone else ya can always land an alum's kid....

unc identifies employees facing dismissal over athletics, academics scandals


unc officials Wednesday disclosed in a settlement over a public records lawsuit that four employees were either fired, resigned or are in the process of being fired in the wake of a detailed investigation into the longstanding academic fraud that primarily benefited athletes.


Among those the university is seeking to fire is Jan Boxill, the former faculty leader who was found to have steered athletes to classes that she knew had no instruction. Boxill is a philosophy professor and former head of a unc center for ethics. unc officials said Boxill is appealing "the University's intention to discharge her." Her case is now before the University Faculty Hearings Committee.


The others are:


• Timothy J. McMillan, a senior lecturer in what was formerly known as the Department of African and Afro-American Studies, where the fake classes were created by a former departmental manager. McMillan resigned from his position effective Wednesday.


• Jaimie Lee, an academic counselor in the Academic Support Program for Student-Athletes, who had steered athletes to the fake classes and asked the former chairman of the AFAM department to create one. unc officials said she was given "notice of discontinuation" of her job on Oct. 22.


• Beth Bridger, another former academic counselor in the athlete academic support program who left unc in 2013 but had recently taken a similar job at unc-Wilmington. Officials there had confimed her job had been terminated on Oct. 22.


Six others are in the midst of disciplinary proceedings, and unc officials said they will identify any employee who is disciplined, as well as say if any of the six were determined not to require disciplinary action.


The lawsuit was filed in late November by attorneys representing a coalition of media organizations, including The News & Observer and The Charlotte Observer. The lawsuit followed numerous efforts by reporters to find out any disciplinary actions taken against unc employees that were involved in the scandal.


unc Chancellor Carol Folt said on Oct. 22, when a report was released showing a long-standing scheme that was primarily used to help keep athletes eligible to play, that nine employees were facing disciplinary actions. Four of them were facing the termination of their jobs, she said. But she declined to identify who the nine employees were or why the actions were being taken.


State personnel law requires officials to disclose dismissals, suspensions and demotions of public employees. If an employee is dismissed, the law requires the public agency to write a letter explaining why. That letter is a public record.


unc officials contended the information could not be released until the employees in question had exhausted all appeals.


Donald Stephens, Wake County's chief resident Superior Court judge, sent the case to mediation earlier this month after a hearing.


He told attorneys at the time that he was "troubled" that Folt told reporters that nine people would be terminated or disciplined but offered no details on which employees or why.


The report by Kenneth Wainstein, a former federal prosecutor hired to investigate allegations of academic and athletic fraud, found that more than 3,100 students - about half of them athletes - took bogus classes in African and Afro-American Studies over an 18-year period that ended in 2011.


In a memorandum released on Wednesday, Folt explained why the university agreed to release the information about employees this week.


"Just over two months ago ...the university pledged its full commitment to restoring trust, continuing to implement a broad range of reforms, and holding individuals accountable based on facts and evidence and consistent with fair process and appropriate respect for their privacy," Folt said in the memorandum.


Folt stated in the memorandum: "In light of the extraordinary circumstances underlying the longstanding and intolerable academic irregularities described in the Wainstein Report, as well as her role as chair of the faculty council during a period of time covered by the report, and in order to preserve the university's integrity, it is necessary to disclose" that on Oct. 22, unc officials informed Boxill of their intent to terminate her employment. Boxill requested a hearing, according to Folt, before a faculty committee, part of the appeals process.


"With this and all actions we take, it is our intention to be transparent and responsible, committed to excellence and integrity in everything we do," Folt stated.

Education trumps the big game


This year presented polar opposite approaches to college sports. Union's non-athletic scholarship Division I hockey program won the national championship in April; in October, the University of North carolina's famed basketball program, run by icons Dean Smith and Roy Williams, was revealed to have enrolled athletes, over 18 years, in bogus courses to keep them athletically eligible.


Both Union's 7-4 victory over the University of Minnesota, and unc's academic scandal were scripts from Hollywood. One was a fairy tale; the other a horror story.


At least one does not need them in hockey. Besides Union, Cornell, Harvard and Yale have won—without athletic scholarships—national championships. With true student-athletes, one also does not need to worry about unc-type debacles, because real student-athletes understand their attendance at the college is for an education.

I agree. Expect nothing different from that cheating bunch over there. Nothing has changed with any of that bunch over there. Another nugget that nothing has changed:


I personally witnessed on New Years Eve as I was flying the last leg of my trip that went from CLT to RDU....low and behold it was Fats Thomas with two football players dropping cash for their stuff at the terminal gate before we boarded. Two players dressed "to the nines" wearing 24K Beats Studio headphones, ALL 3 sat first class together and the stewardess had to repeatedly tell them to keep their rude behavior at a minimum (throwing trash at each other). At baggage claim, they each pulled at least $7-$10K worth of Louis Vuitton Couture luggage off of the conveyor belt. I never witnessed what vehicle they left RDU in, but I would guess probably a "carwheel".
 
"Following college recruiting" ranks one notch ahead of "sniffing bicycle seats" in the pantheon of Worthwhile Human Endeavors. That adult bi-peds do either explains a great deal about a great deal..... Recruiting addicts are the equivalent of 14 y/o girls who know the names of all the Kardashians' pets.


I mention that because apparently all is now hunky-dory again on Franklin Street. Oh sure, accreditation is still "in peril" (like who cares? Really.) and Little Carol is supposedly trying to fire Jan Boxill but she can't "because"..... and there's that "toxic locker room thing" and.... and BUT: Not to worry Bunky.....


Ol' Roy has done gone and signed Raymond Felton's nephew.... sort of, maybe. No, not for next year. No, not for the year after that. For 2017. At 12:47 AM Friday morning I got an email from a Legendary Tar Heel Booster of Mythical Status. In Vegas, one's insider status is measured by "he shook Sinatra's hand". In Chapel Hill, that might be "has he seen Dean barefooted?" My email was from a Famous Franklin Streeter who, I'm quite certain, "has seen Dean barefooted".


His email query to me read..... "Have we really vetted this guy?" He was asking ME?


"This guy" he was referring to was, of course, Gene Chizik - POSSIBLY The Brand New Defensive Coordinator of the Fighting Fedorians.


I can't come up with a perfect analogy. If I can't nobody can. Lets go with - Larry Fedora hiring Gene Chizik would be on a par with Ol' Roy hiring Jerry Tarkanian.


My reply to his email was .... "I've got calls-in to Little Carol and Bubba meanwhile I think we can dismiss any rumor that Carolina will be deemphasizing Football for the foreseeable future." Indeed!


At $750,000/year, Gene Chizik would immediately become UNC 4th highest paid guy..... after Roy, Larry..... and, of course, Ken Wainstein. I realize UNCHealth's Bill Roper is probably #3 but nobody reading this knows who Roper is. Wainstein is waaaaay funnier.


Ya just know the UNC Faculty folks concerned about over-emphasis on sports is loving that "an assistant coach" might be making more $$$$ than Little Carol and Joel The Spinmeister COMBINED. "AN ASSISTANT COACH". Gene Chizik would make 3X what "that other Gene (Nichol)" makes..... For an historical perspective, John Bunting was making "only $600,000" as Head Coach just a few years ago.


Is it true that UNC cannot actually Hire Gene Chizik until they actually Fire Jan Boxill? That could be quite a while apparently.

Its not that Chizik might create an Iron Curtain "amid the pines" at all. It is that, well Gene has some "baggage" from his last coaching gig. Gene Chizik would bring more "baggage" than Kim Kardashian would need for a long week-end in Cabo.

SUPPOSEDLY "somebody" slipped Cam's daddy a big roll o' Benjamins to come to Jordan-Hare. If that "somebody" UNC Latest Possible Hire, it was someone in his inner circle. ...... There was a whole lot of other recruiting and eligibility flim flaming going on under Chizik's Watch at Auburn. A Whole Lot!!! For sure Gene, like every Big Time Coach, "didn't know nuthin' 'bout nuthin". Those Sgt Schultz helmets are de riguer for every Big Time Head Coach these days.


Is it significant that Gene Chizik's application for the UNC gig lists John Blake as a character reference?


Hellfire... Chizik hired Trooper Tyler as "his John Blake". Trooper Tyler was so dirty his nickname was "Pigpen".


Anyone who seriously believes "Little Carol From Dartmouth" has ever heard of Gene Chizik, John Blake, Trooper Tyler or Cam Newton's daddy probably believes Ken Wainstein's firm takes Pro Bono cases.

Scarbinsky: Gene Chizik set the table for his own dismissal at Auburn


They were all warned.


Gene Chizik's football program was coming apart at the seams.


Some of the problems, like a number of arrests and behavior issues, were public and obvious.


Some players weren't going to class. Others weren't working out. What should have been mandatory workouts became optional, and the authority of head strength and conditioning coach Kevin Yoxall was severely undermined.


One example: During the second week of the regular season, before the cracks in the foundation began to show up on the field in a lifeless 28-10 loss at Mississippi State, an academic adviser told Chizik there was a problem with one of his Auburn starters.


The adviser said the player wasn't going to class, wasn't doing his classwork, wasn't making much of an effort at all in the classroom.


Chizik's response: He told the adviser he didn't believe him. That player started the Mississippi State game and struggled terribly, never showed much development on the field and eventually lost his starting job.


That's how you go from 14-0 to 3-9 in two seasons, from winning all nine SEC games in 2010 to losing 10 straight games in the conference between 2011 and 2012, including all eight this season.


That's how you spiral from winning the national championship to losing your job, as Chizik officially did Sunday, in record time.


One player at a time. One standard compromised after another.


The program's inner turmoil gained its first widespread attention two months after the BCS Championship victory when four players were arrested and charged with armed robbery. At the first trial of one of the accused - Antonio Goodwin was found guilty and sentenced to 15 years in jail - two players, including Dyer, admitted to having smoked synthetic marijuana.


Unanswered questions remain. How widespread was that drug use, before and after the drug became illegal? When did Auburn coaches or officials become aware of it? What was done about it?


Chizik seemed to change after the national title. It's not uncommon for coaches to write books after that kind of season, but his - "All In: What It Takes to Be the Best" - was far more about him than about the team.


On the field in 2011, Chizik began to assert himself more in the game plans, especially on offense, where he wanted Malzahn to slow down the offense to protect the defense. Chizik's meddling combined with Malzahn's desire to be a head coach led to Malzahn taking a pay cut to take over at Arkansas State. His 8-3 Red Wolves will play Saturday against Middle Tennessee for the Sun Belt title.


Bottom line: Chizik failed in terms of player discipline and player development. He failed in replacing valuable assistant coaches from Malzahn to defensive line coach Tracy Rocker. He failed to either spot the problems in his program or to adequately address them.


At the end of his tenure, Chizik is what a lot of people thought he was when Auburn hired him with his 5-19 record from Iowa State.


Nick Saban did eat him for breakfast, but Chizik himself set the table for his own dismissal.

As athletic director, Baddour was paid a base annual salary that in his final years reached $295,000. But he earned tens of thousands of dollars more in bonuses tied to postseason play and academic performance. Treasurer's records show his total annual pay over the last four years of his career averaged $437,000.


Baddour said he earned the bonuses that boosted his pension.


"I believe the bonuses that I was paid, they were earned," Baddour said. "They were earned on the field and they were earned ... in the classrooms. And I believe that the administration was helpful to the success of students, certainly through student support, through the academic support program, through the carolina Leadership Academy and the student-athlete development programs that we have."

Before biting on this one, I decided to wait and see if there was a 'just kidding' press release forthcoming.
My question now is, is tequila being served at unc athletic department executive meetings? I know alcohol is alcohol chemically speaking but tequila in particular has the re*****tion of producing a bulletproof feeling.

On the Mary Willingham situation: All the things she was criticized for remain true: her data analysis was outrageously wrong, her mode of working through the media irresponsible, her release of student information a violation of FERPA, her reckless violation of IRB regulations including obviously false answers to simple questions, straightforward plagiarism of her thesis on this topic, her willful mischaracterization of that thesis via CNN. Her presentation to FAC on 12/10/13 was an enormous missed opportunity; instead of presenting information, she was pushing a literacy-for-credit training program at carolina, which IMHO is a terrible idea, though I'm sure from her limited experience it seemed like a good solution. Numerous requests from FAC members to be specific with explaining the problems she'd actually witnessed were unanswered. She didn't accept an invitation to return. The kernel of her claim - that there were woefully underprepared athletes at carolina, and that some of these athletes had used measures like the fake classes to maintain eligibility - was true, but was unremarkable at the point she was making the claim since the presence of the fake classes had already been discovered and widely publicized. The specifics - grade-level reading scores, frequency of academic unpreparedness, legitimacy of her "research" - have been shown to be wrong in various ways. While I know she did what she believed was right throughout, it appears to me that sometime around 12/13 she got tired of the more responsible, collaborative route that characterizes most university governance and decided to go public by exaggerating and sensationalizing claims. This is also about the time that the message she was broadcasting starts to be as much about herself ("whistleblower," "hostile environment") as about the issues.


McAdoo too...


On the Michael McAdoo Lawsuit: McAdoo, a former unc football player, is suing unc for failing to provide him a true education. He claims he was "forced" to major in one of a few options, and that he took one of the fake classes to maintain eligibility. (As it turns out, he heavily plagiarized the paper he turned in for that class: one of the original revelations early in the scandal.) unc has already said anyone who took the fake classes can take replacement classes at no charge, so he has the opportunity to make up the class. He apparently had to cheat even to pass the fake class he was in! And he certainly knew the character of the classes he was taking at the time. Furthermore, there is no right to major in any particular field; you have to be admitted to a major based on prior performance. IANAL, but this lawsuit seems like a major stretch to me.

Several of the former unc academic counselors do not trust any journalists enough to grant them interviews, but the former academic counselors do trust me. If I can acquire the resources to conduct and then present those interviews as part of a documentary film criticizing the media's sensationalism over the paper classes at unc, I believe those interviews and the film will effectively undermine the narrative of an athletics scandal.


Soon I will be announcing plans for the film and asking for your help. If this film can be made, those committed to the truth at unc will have reason to celebrate.
